Kairos3D srl, headquartered at Via Agostino da Montefeltro 2 – 10134 Turin (TO), Italy, VAT No. IT10190870013 – REA No. 1112941, represented by its legal representative pro tempore, hereinafter referred to as the Data Controller, hereby informs you, in compliance with Articles 13-14 of EU Regulation No. 2016/679 (GDPR), that for the establishment and execution of ongoing contractual relationships with you, our organization holds your data, which may have been obtained verbally, directly, or through third parties, and is classified as personal data under the GDPR.
In accordance with the indicated regulations, the processing of your data will be based on principles of fairness, lawfulness, transparency, and the protection of your privacy and rights.
Pursuant to Article 13 of the GDPR 2016/679, we provide the following information:
Nature of Data Processed
We process your personal, tax, and economic data necessary for the performance of existing or future contractual relationships with your company, as well as for effective management of commercial relationships.
The data is processed without your explicit consent (Art. 24, letters a, b, c of the Italian Privacy Code and Art. 6, letters b, e of the GDPR) solely and exclusively for the following Service Purposes:
- Fulfillment of pre-contractual, contractual, and fiscal obligations arising from relationships with you;
- Compliance with obligations under laws, regulations, EU legislation, or orders from Authorities;
- Management of technical support services related to marketed products;
- Management of external collaborations;
- Exercise of the Data Controller’s rights, such as the right to defend itself in legal proceedings;
- Any other operational and managerial requirements.
Only with your specific and distinct consent (Articles 23 and 130 of the Italian Privacy Code and Article 7 of the GDPR) will data be processed for the following Additional Purposes:
- Remote access for training and/or support purposes;
- Sending notifications and/or newsletters via email regarding existing service contracts with your company.
We do not hold any data about you that can be classified as special or judicial data (Articles 9 and 10 of the GDPR).
Browsing Data: The IT systems and software procedures used to operate the website collect certain personal data, the transmission of which is inherent to the use of Internet communication protocols (e.g., IP addresses or domain names of computers used by users connecting to the site, URI – Uniform Resource Identifier – addresses of the requested resources, request time, method used to submit the request to the server, size of the file obtained in response, numerical code indicating the server response status – success, error, etc. – and other parameters related to the user’s operating system and IT environment). Although this information is not collected to be associated with identified users, by its nature, it could allow the identification of users through processing and associations with data held by third parties. This data is used solely to obtain statistical information on the use of the site, unrelated to any user’s identity, to ensure its correct operation and is deleted immediately after processing. The data may be used to ascertain liability in the event of hypothetical IT crimes against the website.
Purpose and Duration of Data Processing
Your data is processed for the entire duration of the contractual relationship and thereafter, for contractual needs and compliance with legal and fiscal obligations, as well as for effective management of financial and commercial relationships, as indicated in Article 4 of the Italian Privacy Code and Article 4, No. 2 of the GDPR. The Data Controller will process personal data for the time necessary to fulfill the purposes listed above and, in any case, for no longer than 10 years after the end of the relationship for Service Purposes.
Processing Methods:
Data processing will be carried out using both manual and electronic or telematic tools, organized and processed strictly in relation to the purposes themselves, ensuring the security, integrity, and confidentiality of the data in compliance with the organizational, physical, and logical measures required by current regulations.
Obligation or Option to Provide Data:
Providing your data is optional. However, as for data that we are required to know to comply with legal obligations, failure to provide such data on your part will make it impossible to establish or continue the relationship, to the extent that such data is essential for its execution.
Scope of Access to Your Data:
The following categories of individuals may have access to your data, as processors or persons in charge of processing appointed by this company, the Data Controller: executives, administrators, auditors; internal secretarial offices; accounting and billing staff; personnel involved in the marketing of services; agents and representatives.
Communication and Disclosure:
Subject to disclosures made in compliance with legal obligations, all collected and processed data may be communicated and disclosed to financial institutions for the management of collections and payments, financial and insurance institutions, auditing firms; employees or collaborators; external entities involved in the execution of the contract (such as transporters, software license providers, etc.), as well as third parties. Any communication and disclosure of such data will be linked to the operation of the economic activities of our company. Your Rights:
As a data subject, you are entitled to the rights provided by Article 7 of the Italian Privacy Code and Article 15 of the GDPR, specifically: to obtain confirmation of the existence or non-existence of personal data concerning you, even if not yet recorded, and the communication of such data in an intelligible form; to obtain information on: a) the origin of the personal data; b) the purposes and methods of processing; c) the logic applied in the event of processing carried out with the aid of electronic means; d) the identifying details of the data controller, the processors, and the designated representative as per Article 5, Paragraph 2 of the Italian Privacy Code and Article 3, Paragraph 1, GDPR; e) the entities or categories of entities to whom the personal data may be communicated or who may become aware of it as appointed representatives in the State, as processors or persons in charge of processing; to obtain: a) the updating, rectification, or integration of data; b) the erasure, anonymization, or blocking of data processed unlawfully, including data that does not need to be retained for the purposes for which it was collected or subsequently processed; c) a declaration that the operations in letters (a) and (b) have been made known, including their content, to those to whom the data was communicated or disseminated, except in cases where such fulfillment is impossible or involves a manifestly disproportionate effort with respect to the right being protected; to object, in whole or in part: a) for legitimate reasons to the processing of personal data concerning you, even if relevant to the purpose of collection; b) to the processing of personal data concerning you for purposes of sending advertising or direct sales material or for conducting market research or commercial communications through automated calling systems without the intervention of an operator via email and/or traditional marketing methods via phone and/or paper mail.
Where applicable, you are also entitled to the rights provided by Articles 16-21 GDPR (Right to rectification, right to erasure, right to restriction of processing, right to data portability, right to object), as well as the right to lodge a complaint with the supervisory authority. At any time, you may obtain confirmation of the existence or otherwise of personal data concerning you and the communication of such data and the purposes on which the processing is based. Additionally, you may request the erasure, anonymization, or blocking of data processed in violation of the law, as well as the updating, rectification, or, if you have a specific interest, integration of data. You may object, for legitimate reasons, to the processing itself.
Please promptly notify the company’s relevant office of any changes to your personal data so that we can comply with Article 11, letter (c) of the aforementioned regulation, which requires that collected data be accurate and, therefore, kept up-to-date.
